Elon Musk and Sam Altman are set to face off in a federal trial starting Monday in Oakland, California. This civil trial involves Musk suing Altman in a case that mixes business disputes with personal grievances. The outcome may significantly influence the future of OpenAI and its prominent app, ChatGPT.

The trial is expected to last four weeks, with key tech executives slated to testify. Witnesses are likely to include Musk, Altman, Microsoft CEO Satya Nadella, and various OpenAI board members. Judge Yvonne Gonzalez Rogers remarked on the situation, calling it a case of ‘Billionaires versus billionaires.’

The core issue revolves around OpenAI’s shift from a nonprofit organization, founded in 2015, to a for-profit entity. Musk and Altman were co-chairs of OpenAI at its inception. Following a restructuring in October, the for-profit segment still reports to a nonprofit foundation.

Musk, who now leads a competing AI startup named xAI, asserts that OpenAI’s transition to for-profit status was a betrayal. He claims Altman and others misled him by accepting his investment and support under the guise of creating a public-benefit organization.

Musk initiated legal action against Altman and several co-defendants in 2024, seeking restitution estimated at $134 billion. Altman’s team argues Musk is distorting the truth. They maintain that Musk departed from OpenAI in 2018, failing to fulfill his $1 billion commitment.

According to Altman’s side, Musk previously agreed on the necessity of converting OpenAI into a for-profit to secure funding. They suggest Musk aimed to control OpenAI, advocating for its integration into Tesla.

Both parties seem eager to present their cases in court. Musk expressed anticipation for the trial, stating, ‘The discovery and testimony will blow your mind.’ Altman also conveyed enthusiasm, saying, ‘Really excited to get Elon under oath in a few months, Christmas in April.’
